Terms of Service

By accessing or using AgentContainer ("the Service"), operated at agentcontainer.co, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. Your continued use of the Service following any changes to these Terms constitutes acceptance of those changes.

AgentContainer is a software-as-a-service platform that provides cloud containers for running AI agents. The Service allows users to create accounts, generate API keys, configure and execute AI agent tasks within managed container environments, and manage billing and credits associated with their usage.

You are responsible for maintaining the confidentiality and security of your account credentials, including any API keys generated through the Service. You agree to:

• Provide accurate and complete information when creating your account.
• Keep your login credentials and API keys secure and confidential.
• Notify us immediately at support@agentcontainer.co if you suspect unauthorized access to your account.
• Accept responsibility for all activity that occurs under your account, including activity initiated through your API keys.

You may revoke API keys at any time through your account dashboard. We strongly recommend rotating API keys regularly and revoking any keys that may have been compromised.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

• Deploy agents that engage in malicious, harmful, or illegal activity.
• Use the Service to distribute malware, conduct phishing attacks, or perform unauthorized access to third-party systems.
• Abuse platform resources, including but not limited to cryptocurrency mining, denial-of-service attacks, or excessive resource consumption intended to degrade the Service.
• Attempt to circumvent usage limits, billing mechanisms, or security controls.
• Use the Service in any manner that violates applicable laws or regulations in your jurisdiction.
• Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure.

We reserve the right to suspend or terminate accounts that violate this acceptable use policy, with or without prior notice.

Certain features of the Service require the purchase of credits or are subject to usage-based fees. By purchasing credits or using paid features, you agree to the following:

• All fees are stated at the time of purchase and are charged in advance or upon usage, depending on the billing model.
• Credits are non-transferable and, unless otherwise stated, non-refundable.
• You are responsible for monitoring your credit balance and usage. The Service will not execute tasks if your account lacks sufficient credits.
• We reserve the right to change pricing at any time, with reasonable notice provided to existing users.

Your Content. You retain all rights to the data, configurations, and AI agents you create or upload to the Service. By using the Service, you grant us a limited license to host, process, and execute your content solely for the purpose of providing the Service to you.

Our Platform. The Service, including its software, design, branding, documentation, and all related intellectual property, is and remains the property of AgentContainer. Nothing in these Terms grants you any right to use our trademarks, logos, or brand assets without prior written consent.

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation of the Service. We may perform maintenance, updates, or modifications that temporarily affect availability.

We make no warranties or representations regarding uptime, reliability, or availability of the Service. We shall not be liable for any downtime, data loss, or service interruptions.

You may terminate your account at any time by contacting us at support@agentcontainer.co.

We may suspend or terminate your access to the Service immediately, without prior notice or liability, if:

• You breach any provision of these Terms.
• Your use of the Service poses a security risk or may adversely impact other users.
• We are required to do so by law or regulatory authority.
• We discontinue the Service or any material part of it.

Upon termination, your right to use the Service ceases immediately. Any unused credits may be forfeited upon termination, except where prohibited by applicable law.

To the maximum extent permitted by applicable law, AgentContainer and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service.

Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you have paid to AgentContainer in the twelve (12) months preceding the claim.

The Service is provided "as is" without warranty of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements or that the results obtained from using the Service will be accurate or reliable.

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Effective Date" at the top of this page and, where appropriate, notify you via email or through the Service. Your continued use of the Service after any changes take effect constitutes your acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall first be addressed through good-faith negotiation. If a dispute cannot be resolved informally, either party may pursue any remedy available under applicable law in a court of competent jurisdiction.
